I Caught My Coworker Recording Me At Work.

Card image cap

I am a nightshift nurse at a hospital. Over the past few weeks, one of my coworkers who is frequently a day shift charge nurse has been reporting me to our boss for things that are not worth reporting. For example, I forgot to give report to someone before leaving one day. Everyone has done it. It was a genuine accident. Most people would have called and had you give report over the phone. She didn’t call me. She called my boss at home on a Saturday morning to make it a big deal. Boss said it happens, okay. Another time, I stayed over two hours charting because I spent my whole night doing ultrasound IV and blood draws for the floor as I was the only trained employee on the floor that night. She called my boss to let her know I was still there and then confronted me as if my boss told her to ask why I am still there. Yesterday, as I was leaving, backpack on and everything, I poked my head into one of my patients rooms to say something to the nurse I just gave report to but I saw this person in my peripheral and said never mind and closed the door. When I walked by, I saw she had her phone up recording me. I immediately went to my boss and told her everything that’s been happening and she confirmed that she never told her to do any of these things. Is it legal for her to be recording me without my knowledge or consent on her personal phone? I live in Virginia.
