I Fell 10 Minutes After An Outpatient Procedure, Three Feet From The Office Door, And Was Severely Injured. Do I Have A Case?
I had a vasectomy yesterday morning using only local anesthetic. When my urologist finished he told me to get dressed and hit a call button for someone to give me my after-care handout and they would lead me out. He left the room right away. I felt fine so I did, walked out to the lobby, got my wife and our baby and left the office immediately. As soon as we left the office and were waiting for the elevator outside (we were on the second floor of a medical building attached to a hospital) I lost consciousness and fell on my face.
When I came to, the office staff got me a wheel chair and took me to the emergency department in the adjacent hospital where I got a CT and they determined I needed to be transferred 120 miles to a specialist.
My jaw is dislocated on both sides and fractured in five places. I lost one tooth so far, may lose others in surgery later this morning, and at least one eye tooth is broken in half with that piece imbedded in my lip. My jaw may be wired shut for up to six weeks if they can’t get to all of the fractures with plates and screes and I am certainly on a liquid diet at least that long.
Is my urologist or his practice (a corporate surgical practice) at all liable for my injury? A few hours after my fall he came to see me in the ED and introduced himself to my nurse as “I’m the one who did that to him”. I like the guy, I know this was an accident, but I remodel homes with a friend and will be out of work for a long time. I’m already on SNAP and Medicaid and my wife is on SSA disability following a kidney transplant three years ago. I don’t want to be an ambulance chaser but I don’t have much financial resource or even dental coverage if I need that down the road to fix any of this.
