I Got Rear Ended, My Car Is Totaled, And The Other Driver Isn't Answering Calls. Help!

I got rear ended on a highway in Texas at ~30mph by a driver that wasn’t paying attention (I honked at him, he was wearing Airpods, and he admitted guilt at the scene). I rolled into the car in front of me which caused minimal damage to them, but my car is totaled. We exchanged information, there's a police report with everyone's contact information and insurance, and I have photos from the scene.

The guy's insurance provider hasn’t been able to get a hold of him. The insurance provider told me the following...

  • they can't proceed with the claim unless they hear from him
  • even if they did hear from him, they will only pay for the "salvageable value" of my car, which is basically nothing since it's totaled
  • if I move forward with my own insurance, they will not reimburse me for my deductible if they can't get in contact with him

I'm still waiting on the police report to be published. Assuming that the police report shows that the guy who hit me is liable, does anything that the guy's insurance provider said still hold up?
