I’m 21, Is There Any Way To Get A Hold Of/separate My Money From The Custodial Account My Mom Created Without Her Permission?
MAIN QUESTION AT THE BOTTOM
i previously made a post on reddit about my mom, she kicked me out in a pretty traumatic way, and was insisting she should have my old car (quick update on that: i still ended up junking it). had my bf explain that it wasn’t safe and, even after her ridiculing me about it, i still ended up helping her find a decent car through one of his coworkers.
anyways, new year new issues. like i said in the last post about her, she kicked me out in april, i had been helping pay for her house for a bit before then but i refused once i stopped living there. up until she transferred the title of my old car into my name i was already paying for the maintenance and i was paying for the insurance through her, now obviously that’s all under my name. i am still paying her for my phone bill because it’s cheaper since she has a family plan.
my main issue right now is that my bank account is still under her name or whatever, i can’t think of the actual term for it but basically even though it has my name listed she still has COMPLETE access to it. maybe a custodial account i think? it was made when i was 15/16 and got my first job. anyways, she will still take money out of my account OTHER than the phone bill i agree to without letting me know, and then text me later telling me she will pay me back (she usually has, but i still don’t think it’s fair to have $250 randomly pulled out of my checking without previous warning). i’ve paid my own taxes through this account for the last 2 years, i saved my own $15,000 for my new car last year, it’s linked to my credit card, my bank statement from that account was one of the documents i used to get my 21 license this year, etc…
as far as i’ve been told, in order to get that original account transferred completely to me, including my loan on my new car, both she and i have to be present at the bank and she has to sign because she was the one who originally opened the account when i was still a minor. she has repeatedly REFUSED to do this.
******i guess my main question for this sub is if i have any right or any possible way to get this money from the custodial account to an account for myself only, specifically since as of now she doesn’t want to give it up. it’s been purely my income since 2019, although i didn’t have anything steady until 2022. i’ve thought about just opening a new account in my name at a different bank and just sending all of my money there but i have no clue if that’s legal or not with an account that, at the top, is named under her
