I Think I May Be Getting Sued Soon And I’m Not Sure What To Do.
So, to preface, in May of last year I was involved in a car accident. It was initially unclear as to who was at fault, and so no ticket at the scene was issued. As it turns out, I had been found at fault, and a month or so later, I was issued a ticket for careless and imprudent driving. Here’s where the situation gets complicated. The other party refuses to close the claim and sign the necessary paperwork to subrogate, and we are unsure why. She stopped responding to her own insurance company last month regarding the incident. My attorney has continued to file motions of continuance in order to make sure we can reduce the ticket once the claim is closed, but obviously this cannot be done if she refuses to cooperate. I’ve speculated that she may be waiting for the careless and imprudent ticket to hit my driving record so that they can use that as proof of negligence in a civil suit. I will be contacting my attorney tomorrow to find possible ways to proceed from here, but I wanted additional consultation from the sub to see how this situation could possibly play out. Am I screwed?
