Is It Impossible To Sue A Contractor?
I fear we're needing to sue our roofing company who after 12 months has done nothing but further damage to our roof. We were told by a couple of people it would be nearly impossible to find a lawyer who would go up against a construction company since they'd rather have their business than ours. Is that accurate?
For background I think we have a pretty solid case and all we're asking for is our deposit back:
We contacted them in January 2024 and were told they'd be able to start in March or April depending on weather. After following up over and over, they finally started work in August. Despite our large house and complicated roof they insisted it would take 2-3 days max. After a little over a week with the crew only showing up for a couple of hours a day, there was a storm coming and we contacted the project manager and he eventually came out and laid a tarp. A couple of weeks later they said they were finishing up and my husband went up there and everything was a mess and done terribly. We sent them photos and they said they could come back out and fix it. Again a month or so of following up before they could get another crew out to fix things. This next crew installed shingles on a day it was too hot to roof, walked on them and damaged the shingles. They also cut massive chunks out of our historic trim and siding (the house is 140 years old) and put pine boards up in their place without talking to us first. Again we said they needed to fix it and after another couple of months of back and forth they came and replaced the siding using a reclaimed wood supplier we'd found for them. They'd said they could replace the damaged shingles too so we said ok, only to have them show up and say actually those can't be replaced it needs a full reroof. At this point we'd had it and asked for our deposit back so we could bring in another crew to re-roof. All they're offering us is 2K out of or 15K deposit and insisting we need to pay for the work they've done even though it all needs to be re-done by another company and they've now wasted 12 months of our time and we're going into winter without a finished roof (we live somewhere with a lot of snow pack)
We've kept all text message conversations with them, and have photos of all of the damage.
We've reached out to the state licensing board, BBB and state attorneys general but I'm not sure what else to do and they're now blocking our calls and ignoring our texts. I really don't want to get into a lawsuit but paying someone 13K for a job that needs to be completely redone feels like theft.
Does this seem like a reasonable case? Any suggestions on finding a lawyer to take our case or estimates of how much it would cost? We've reached out to a couple of people with no responses back.
