Is It Worth It To Pursue Legal Action Against My Former School?

Card image cap

I was an educator in NC during the 2023-2024 school year at a special education school. The school was a complete mess and often did not follow legal rules/ regulations for the safety of staff and students. Towards the end of the year a student hit me on the head and gave me a pretty bad concussion. The student stayed in my class (I was an elective teacher so he could have been moved) and I was forced back into the classroom before I was physically (or mentally/emotionally) better.

It was an awful experience. My questions are:

  1. Is it too late to pursue any legal action?

  2. Would it be worth it?

  3. Who should I pursue legal action against? The school/ county/ student/ principal? The teacher who spread lies about it not happening adding to the terribleness of the situation?

Any info would be amazing. I want to put this all behind me, but to be honest I never want to teach again and would like some capital to start my own business.
