Just Got A Court Summons In The Mail, Because My Fiancé Called The Cops When I Overdosed At Home.
First off, I live in Arizona. I overdosed in June on Xanax. My fiancé thought I was going to die because I was slow at responding so she called 911. The ambulance took me and a couple hours later I left the hospital. It’s been 6 months and today I received a court summons to be at the courthouse January 21st for a misdemeanor paraphernalia charge. (A straw).
My family are all very upset saying that this is breaking the Good Samaritan law. Which is this: A person who experiences a drug related overdose, who is in need of medical assistance and for whom medical assistance is sought pursuant to subsection A of this section may not be charged or prosecuted for the possession or use of a controlled substance or drug paraphernalia if the evidence for the violation was gained as a result of the person’s overdose and need for medical assistance.
They found zero drugs, and the only reason they found my straw was because I was in the bathtub when the cops and paramedics were loading me on the stretcher and the cops started opening drawers in the bathroom and went through the trash can, where they located the straw. ( I know this because my fiancé was in the same room freaking out on them for doing this.)
My question is what should I do?! I’m so worried and have a newborn son so I can’t afford a fancy lawyer or huge fines. Also, it’s now on my background check as pending so I’m probably not going to get this new job. I’m bummed and worried. Any advice would be greatly appreciated! Thanks, Ry
