Kars4kids Issues

Card image cap

Back in July my wife and I donated an old scooter she had to Kars4Kids. We included the necessary paperwork (title, etc) with the scooter. We both live in Pennsylvania, and the scooter was registered in Pennsylvania.

A month or two later we get a letter informing us that because the title was in my wife's maiden name, we would have to send in a notarized power of attorney sheet (that they sent us), along with a copy of our marriage license and scans of her drivers license.

We went an paid for a notary for the paperwork and sent scans of both of those things in. We got an email from them indicating that they received the paperwork. A month later we got another letter asking for the same information. Then another. Then a series of emails "reminding" us about sending that information in.

Finally an email today informing us that if we didn't send the papework in (apparently again) in the next week they'll "we will have to proceed with abandoning your car. Kars4kids will not be liable for any violations that may occur."

So my question is two fold: one- given that they've taken possession of the car, if they just abandon it on the side of the road or whatever can we be held liable for that action, and two- If they do and we're held liable, is that actionable on our part? Would there be grounds for a lawsuit?
