Landlord Made Mistake On Signed Lease And Wants To Add Utilities
I’m in California. I signed a lease and paid a security deposit about two weeks ago for an apartment. In the lease it specifically states that “landlord will pay for water, trash, electricity, gas, gardener and internet”
During my tour of the apartment, I inquired about utilities and was told “everything is included except for internet”
The advertisement for the property states that all utilities are included (even internet)
Today, when i scheduled my appointment to get my keys and move in (which is supposed to happen in four days) i got an automated text saying to please have all utilities set up prior to move in.
Out of an abundance of caution, I texted the property manager to make sure that all utilities would be handled by the landlord. She responded: “You are correct - water, trash, electricity, gas, internet, and gardening services are all included in your rent. last message was an automatic message”
She then called me half an hour later stating that electricity, gas, and internet are not included in my rent. She claimed there was an unknown error “in accounting” and I would have to sign a new lease or “back out” of my contract.
Are they able to force me out of the original signed lease? Both myself and the leasing company signed the original lease, with time stamps. I have a screenshot of the original advertisement, as well as her text confirming that utilities are included.
