Lease Requires Receipt Of Professional Carpet Cleaning On Move-out. Is This Beyond Normal Wear And Tear?
Hi, im in upstate new york and was hoping I could get some insight on this, my lease actually mentions carpet cleaning in 2 separate places, one under the 'pets' section and one at the end in the 'move out' section. I do have a cat, which is why I'm including that.
I know that upon moveout, tenants are responsible for anything "beyond normal wear and tear." It was my understanding that unless there were carpet stains that cleaning would not remove, this would not be beyond normal wear and tear. I plan to rent a $25 carpet cleaner from a nearby uhaul place, do it myself, and fight them on it if they have an issue with it. I just want to know from you guys how much of a leg I'd have to stand on since it's included in my signed lease.
The sections of the lease are copied below:
[Under 'Pets' section] "5. Move Out
Upon move-out of Tenants, the carpet will be professionally shampooed, and de-fleaed for the protection of future Tenants. Tenants shall also be liable for deodorization of the Apartment, if such is necessary in the judgment of the Landlord. Such shampooing, de-fleaing, and/or deodorization will be arranged by the Landlord and paid for by the Tenant"
[Carpets]
"Carpets must be shampooed professionally before you leave. All stains that occurred during your residency must be removed. Burn holes, tears, or other damages to the carpet will also result in a charge to your security deposit. Tenants who have an animal must make sure that any animal smell and stains left on the carpet or in the Apartment from the animal are gone when you leave your Apartment. This could take several shampoo applications. Tenants whose animal has damaged the carpet will be charged to replace the carpet."
