Medical Malpractice Urgent Care Using Cna/ma To Educate And Inform Pt. Incorrect Diagnosis Due To Lack Of Time Spent
As the title state, I was misdiagnosed with “active tonsillitis unspecified” by a DNP at an urgent care who saw me for a grand total of 2 minutes. She had her ma run the strep swab and the mono test (which is fine, totally within their scope) but then after both tests were negative, she had the MA return with a prescription paper. She never returned to do a more complete exam (first time in the room she didn’t even look in my throat or ask me about any of my other symptoms). I asked the MA what the prescription was and what it was for. She left the room asked the provider and came back and said that it was for “active tonsillitis unspecified”. I asked why I was being given an antibiotic for that. She said she was unsure. I said I’d like to speak to the provider again. She stated the provider was busy. I went out of the room to get to my car and saw the provider with another staff member laughing at videos on their phones. There was no one else in the clinic!
Fast forward 3 days. No improvement of symptoms, worsening fever. Increasing neck stiffness. Pain when standing . Headache and fatigue worsen. I finally call it and go to the ER. At the ER I am diagnosed with bacterial meningitis. The rash I had gotten on my stomach (had it when I went to the urgent care) apparently is a tell tale sign. Because I came in so late, I ended up having to stay in the hospital for 3 days. It cost me 13,000 dollars. I would like to sue the urgent care and DNP for this cost. Do I have a case for negligence?
