Minors' Inheritance Placed In Trust Controlled By Executor Without Parental Consent
An extended family member died. That person left money to minor extended family members. The executor of the estate is one of the deceased's adult children.
There was a falling out between the parents of the minor children and the executor, who is now stating they are putting the children's money into a trust they will control until the extended family children are 18. Prior to the falling out, this person, who is a lawyer themselves, stated they would give the money to the parents for the children.
I have not seen the will, but do know the language of how the money left to the children can be used was “in the Beneficiary’s best interest” so it’s quite broad.
Can an executor of a will designate themselves trustee of money left to minor children for the purpose of withholding it from the parents?
