My Apartment Leasing Office Employee Stole My Bank Details And Using It To Pay Her Bills.

For context, I have unique credit card called BILT which also has account and routing number (just like a bank account) associated with CC account. The bank account part of this credit card is called ‘Pay Rent’. I can use this as a credit card (when i use the physical card) or use it as a bank account (by using account and routing number). In both cases i accumulate point to redeem for cash back. I use the ‘pay rent’ feature to pay my apartment rent without any extra fee (If I pay with credit card there is 2% extra charges on the rent).

Back in Oct 2023 i signed the lease with this apartment, i was asked to set up payment method/auto pay on their app. The app was very glitchy and wouldn’t accept my banking details. So I went to leasing office and this girl working in office help me set up the payment using their laptop. For this I had to give her my bank’s account and routing number.

After couple of months I noticed unauthorized charge of $248 on my account and called my bank to file dispute. I was initially refunded that money and sent me a new credit card (but the banking details were still same) but after couple of weeks they cancelled the refund. Meanwhile I saw another unauthorized charge around the same day next month. I called my bank again and they said they would investigate about these charges.

After few weeks i gave them a call again because I was not refunded the money yet and to check if they had any lead in their investigation. They said they did get more details about the transaction and asked if I know someone named ‘xyz’ (of course not the real name for obvious reasons). I asked why, they said those transactions were made by this ‘xyz’ person to pay their T-Mobile bill. I was shocked cause this ‘xyz’ person is the girl who works in my apartment’s leasing office and helped set up my rental auto-pay. They also spelled her last name which is pretty common but spelled in a unique way.

I tried asking my bank if they can send the details over an email or mail but their policy wont allow them to. I went up to my apartment’s property manager disclosing everything but she asked me for any proof in written from the banks cause she cannot investigate her employee just based on my words (fair enough). Now I am stuck in a paradox of my bank not providing me written proof and property manager wanting proof.

She kept using my bank for few months and the total charges adds up to around $1500 in total. I know it should not have continued for ‘months’ but my stupid bank would keep swapping credit card instead of bank account number.

Now, can I sue the company who owns this apartment? Considering my personal information were stolen from their office by their employee and being used to pay their personal bills? Also can someone point me to a specific kind of lawyer who would help me sue them because i have been trying to find one but failing at it. TIA.
