My Aunt Died Without A Will.

My aunt died unexpectedly a week ago. She didn’t have a will or a living trust. She has a house and I’m not sure how to go about probate. It’s only my mom, brother and me as her last living relatives. My mom and me are both beneficiaries on her life insurance and 401k. We all want to sell the house and split it three ways but will that be possible without a will? Would it be easier to have it all go to my mom since she is the next of kin?ive also read a lot of horror stories of people getting scammed out of the estate and I’m just worried about how I should go about this.
