My Boss Used A Coworkers Tips To Cover An Issue With The Cash Drawer

I work at a small business in Colorado that is owned by one man and he has 3 employees working for him aside from myself. We are tipped baristas that get a little less than minimum wage because our tips are supposed to make up for the pay difference. I have tried to understand the regulations of the Fair Labor Standards Act myself but have a hard time making sense of it. He takes all of our daily tips home for about a week instead of distributing them immediately. The amount of tips received only has to be divided between two employees per day. I’m not sure if this is a problem by itself, so i would love some clarity on that. My main issue is that a coworker of mine has told me that there was an error in counting the cash drawer one day and the total came out to $64 short of what should have been there based on the transactions that day. My boss, without proof that my coworker was at fault or unable to confirm that there wasn’t an error elsewhere, took that $64 out of her tips to cover the difference. He has stated that he didn’t count the cash drawer in the morning to begin with. Is this illegal and what can we do about it?
