My Financial Aid Was Taken To Satisfy Another Party's Debt. The Court Says My Money Is Entitled To Be Returned To Me. When?
Hi all, I appreciate the help in advance. This is taking place in Utah.
I'm an unemployed college student receiving FAFSA payments to pay for my education. This year (my third year of receiving payments) my bank account was frozen the day after I received my payment. All the funds (including FAFSA and my other funds - no wages) inside were seized and sent to my mother's debt collector as a garnishment. We sent proof that she had not been involved with my account (despite her name being on it - I know, I should have taken her name off as soon as I could) to the debt collector, and later went to court where a judge ordered that the money must be returned to me. My mother has since been taken off of my account. The judge did not include a date/deadline for my funds to be returned to me. When should I expect the funds to return? Do I need to do anything else? Happy to answer any additional questions.
Timeline:
- The initial freeze was in late August.
- Funds were released to the debt collector in September.
- The court date was in late October.
