My Mil Is A Victem Of Domestic Violence. He Sold All Her Belongings While She Was Staying Safe And Away. Police Said Legally He's Aloud To?!?!

My mother in law was admitted to the hospital a month ago for the injuries recived in the assault against her by her husband of less then a year(one of those injuriesbeing strangulationwhich she did black out from).

She did as the police said and had zero contact with him. The police attempted to make contact 2-3 times and failed. There was a Sapina and then a warrent for his arrest. The house they shared is only 4 minutes down the road from ours. so my husband and I would drive by frequently to get his wear abouts. Giving this information to the police about his constant comings and goings. They only staged a stupid fake car accident that my husband and I watched from a distance at 3 am and pretended his car got hit(its on a semi busy road) their "tactics" were fruitless. He came to our house and we called the police but he was gone when they came. I asked the officer that came to my home if we can have then keep the peace to get her belongings while he's home and we have her permission to enter the home. In that instance they would be able to make contact and arrest. They denied putting anyone in a situation like that stating it would be "dangerous" ????

Had they staked out for even a few hours they could have approached him numerous times. But they did nothing over the course of a month!

Just yesterday he was arrested because she herself! staked out and called the police on him as he was loading things into his car and driving off.

While she was keeping safe at her friend/bosses home he sold almost all of her belongings including family sentimental items and heirlooms. Furniture Electronics, sports memorabilia, property of the company she works for. He had a sign outside that said yard sale inside... so you get the idea. He literally owned nothing but clothes. Everything was hers.

The police came today so she could make a report and the officer said since your married he had the right to sell property that you share in your marriage. So basically saying they can't also tack on theft charges. But had they arrested this guy sooner when they had the evidence of the abuse she wouldn't have lost 90% of her belongings. (In the state of utah for legal reference)

We are going to search pawn shops and online market places with posts asking for help in searching/returning the stollen items. And her work will be pressing charges on the equipment he sold, and a laptop he broke.

The police never called to update her on the case over the month, the victims advocate was supposed to be a bridge for communication and seamed very lack lust at doing that.the police closed the case like a week before he was arrested and turned it over to th DA. It was apparent that they didn't show any interest in catching him.

How big of an undertaking is it to sue Westvalley City police department? Is it actually legal for him to sell those items? All my google searches only come up with the topic of divorce. She said she wants to talk to a reporter to see if her story is worth sharing. Not only did he strangle her to the point of unconsciousness, punch and slap her multiple times that her permanent retainer broke, break her work laptop, but he sold most all of her belongings. Because he had all the time to sit there in that house while police did nothing to apprehend him. Had there been a protective order maybe that could have forced him out of the house but the victims advocate advised against it since he would know exactly where she would be staying.
