My Mom Collects Social Security Benefits Under My Name, I Am Listed As Having Medicare And Cannot Get Private Health Insurance, She Will Not Help

I am looking for some major help and advice in the right direction on how to deal with, what is, a pretty convoluted and overall cruddy situation. All of this is happening through the state of Ohio. I now live in New York.

Backstory- back in 2018, my mom "helped" me apply for social security benefits under the claim that I was mentally disabled. She cited my poor mental health history (anxiety, depression, and an eating disorder) and very likely blew those things up to qualify me. Being young and stupid, I did not fight back against it nor fully understand it. She has social security benefits set up with her as the representative payee. During the first year or so of this, she gave me the benefits to use directly. Starting around 2019, I have not seen a penny of those benefits.

Fast forward to November 2024, I have moved states and am trying to get my own privatized health insurance. My state will not allow me to do so because I have Medicare set up. In order to fully cancel Medicare, my benefits need to be fully suspended. When I tried to do so, my mom absolutely blew up. She does not work or provide for the family- she takes the monthly benefit she gets under my name to use for her bidding, and sparing the gritty details I was screamed at and threatened to reinstate the benefits.

I told her no- I am not disabled. I have been working full-time since 2015, provide for myself, care for myself, live on my own, and have not seen a penny of it for years. Medicare knows that too. "No, YOU ARE DISABLED" is what she parroted back. I told her I would not request them to be reinstated, as I need the benefits + Medicare removed if I want to get my own health insurance. I left it that, thinking it would take time for everything to be fully removed.

I checked my SSA account today and found out she has the benefits reinstated. I called, and allegedly she had called and overrode my decision to have the benefits stopped and my Medicare disabled. I asked how I can go about getting health insurance if Medicare is blocking it, and obviously I cannot suspend my own benefit without her consenting to it too, which she refuses to do. They said I can either suspend the benefits, or get Medicare Part B for health insurance.

I do NOT want to get Part B because I should NOT have Medicare in the first place. I feel like she has been playing games with the government office for years and years now and I do not want to play further into it by getting health insurance through, what I see, is fraudulent means. Truly, what are my best options here? Do I need to sue her to get away from Medicare and her name no longer attached to this? Should I suck it up and take the Part B and just let this go on?

I don't know what to do, and it is draining me. I need healthcare but she values receiving money on my behalf far more than my actual health. There is no hope to reason with her, trust me there.
