My Neighbor Shot Through His Floor And Busted Out Water Pipe

I need some major help and advice. So last night we came home from being out of town for the weekend to a completely flooded apartment. I mean every single room, wall to wall, flooded. Turns out, our upstairs neighbors shot through his floor accidentally and completely punctured our water line. Here’s the sticky part! We got a new bank account about a month or two ago, and thought we had switched over all of our bills.. Well, conveniently, our renter’s insurance was the one thing that was forgotten and lapsed/got cancelled on the same exact day this happened. I called and got it reinstated then very next morning but I’m not sure that changes anything. (The only thing we lost in the flooding was our mattress which was on the floor) So i’m not sure if it’s worth a call to them or what. Since our insurance lapsed, our apartment is unwilling to move us to another unit leaving us staying at a family members house. They told us that our only options were to stay in that unit that has been flooded, or pay $2000 to break the lease. Now, they did call a water mitigation company to suck up some water and they put fans out, but they aren’t planning on replacing carpet, opening up the walls to check for potential mold etc. The have a moisture reader and will only take readings from the kitchen, nowhere else. So we went ahead and moved everything out of the apartment because there is no way I will be staying there without them checking for mold spores. But I guess my question is since rent has to be paid asap and we don’t plan on staying, do we just pay rent and try and scrape together the $2000 asap then try and sue to get that money back? do we think they would be willing to waive the $2000? (doubtful, but maybe if taken to court?) we really just want to call it a wash and be done with this apartment complex all together to find a new place asap

So in my account it says that the 12/1 charge for insurance was declined with this email to follow that I somehow missed:

“The most recent payment attempted on your policy was unsuccessful and we may need updated payment information. Your Renters insurance policy for ———- is scheduled to be canceled, due to non-payment, effective 12/28/2024 12:01 am (hour standard time at the address of the insured). Renters insurance may be a requirement of your lease and your property manager may be notified.”

The next email I got was: “The most recent payment attempted on your policy was unsuccessful and we may need updated payment information. We got home yesterday night 12/29 to find the mess I reinstated my insurance this morning 12/30
