My neighbor is an older woman who bangs on her floor and walls every single day with a hammer and other instruments, usually concentrated in the late evening but routinely continuing through 3 AM onwards through sunrise. As of today, she has been banging on her wall from around 3 AM until noon.
I have spoken to her, and she claims she does this, bangs on her wall, because she believes her upstairs neighbors are running a business in their apartment and playing music- you would think she'd hit the ceiling, but she never does. I have been in the hallways, and she has even invited me into her house on multiple occasions, and I have heard none of this noise she claims. I have spoken to her upstairs neighbors, and they say that she has been harassing them for years, and they obviously are just a regular couple living in a regular, new york city apartment.
I and the other neighbors have asked the landlord for help in the past, with no resolution. I have been told by the landlord to call the police, and I have. The police have literally bounced back my noise complaints and told me this is the duty of my landlord to resolve. I have called 911 wellness checks on her multiple times, with no resolution. I have called my city's adult protective services on her, and recently received a letter in the mail that she is ineligible for assistance.
As far as I am aware, legally and medically she is of sound mind. She has told me, to my face, that she does this willfully and deliberately to harass others, and yet I am bearing the consequences and losing sleep over the matter. I have anxiety, and this has exacerbated my condition and contributed to panic attacks.
Is my next step to sue the individual? Can I get a protection order? Should I speak to the police or a lawyer first? Would this be civil or criminal? Am I due damages because of my lost sleep and stress?
