Out Of State And Being Sued For My Boyfriend's Dad's Mortgage After He Passed Away

I alone am currently being sued for the debts owed on my boyfriend's dad's mortgage. The lawyer who took up this case apparently took only the information he could find from the obituary, and did the barest of the bare research from then on, I assume, because the suit doesn't address my boyfriend or myself by our legal first names, and also alleges that I was married to what would be my father in law (if my boyfriend and I were married). I am definitely not married to my father in law.

The state in which my "father in law" passed away, and where the home resides, where the paperwork says that I reside (and is incorrect here as well), is Texas.

Two years ago, we moved out of Texas to Washington state. My would-be "father in law" passed away March of this year. My driver's license was changed to Washington state in 2023.

I have been getting the runaround since I got this paperwork.

  • I don't understand what I need to efile, because I don't know if I should find some kind of lawyer first, and I'm worried about every bit of it.
  • Can't I just call the lawyer who is suing me to say we've never been married? That I've never been married to anyone, except in common law, which doesn't exist in Washington? I've never even filed taxes with anybody, always filed single.
  • What if I'm past-due now to respond?
    • When I got this paperwork, this property company who wants to buy the house told me to wait to respond to postpone the foreclosure! Why did I listen to her!? Boyfriend's mom (they're divorced) organized this entire thing here. I don't know what's going on there.

I don't know what's going on anymore, who and what kind of help I need or how.

I've called the Texas state bar and left a message and I've reached out to a lawyer in the county (Tarrant) who might be able to help.alonw
