Parked Car Hit By Uninsured Underage Driver

My car was hit from the rear while parked (legally) by an unlicensed, uninsured driver. The drivers car was insured but he was the owners son and was driving it illegally. My car was totaled, and trade in value is about $6k and so far we have accumulated about $600 in towing fees.

The drivers insurance will not cover damage because the driver was uninsured, and our insurance will not cover because we do not have collision coverage for the vehicle (only covered for ourselves and other vehicle).

We are not sure how to move forward from this because we suspect that a lawsuit may be needed to obtain repercussions for our totaled car, but would prefer to settle out of court if at all possible.

If we approach the person responsible for the damage, what are some reasonable requests to make? Value of repair for our vehicle is about $13k, but we would not want to ask for that. Should we try to negotiate out of court for the trade in value of our car ($6k) and if so, is there a way to do this in an official, appropriate way (ie email from an attorney, etc.)?
