Paying Mortgage For 1/4 Of An Inherited House

Card image cap

On mobile, apologies. My father passed away in Texas with no will. Probate is close to being finalized by his widow (independent executor of the estate).

I inherited 25% of the property, my sibling 25%, and my father’s widow 50%.

There are no assets in the estate to pay off the mortgage.

The lawyer of my fathers widow sent me a letter requesting if I wish to retain 25% I need to back pay 25% of the mortgage that was paid during probate (about 1.5 years worth) and then pay 25% of the mortgage each month from here on out.

I would like to be bought out by my father’s widow or the house be sold. Father’s widow wishes to remain in the house and not buy the 25% share I inherited.

The lawyer stated if I give my 25% share of the house to my father’s widow, I will not have to pay for the 1.5 years worth of mortgage payments that occurred during probate. The 25% share of the house would be worth more than the 1.5 years worth of mortgage payments they claim I owe.

I have not signed any documents assuming mortgage responsibility.

Am I legally responsible for paying the mortgage?
