Possession With Intent To Distribute?

Ohio. Throwaway account. My boyfriend was working in a public service job. He somehow acquired an unknown amount to me of magic mushrooms. He then attempted to sell them to someone else he worked with. And I believe it was for an amount over $100. All of this happened over text. The other person did not take them apparently and then reported it all to the boss. As far as I know, he got rid of them after this. My boyfriend was then fired and incident was reported to police department. He has now been contacted by a detective at the police department to come in for questioning. He has a lawyer on retainer to go in with him when it’s time but hasnt heard anything back on next steps or possible outcomes from lawyer yet. Wondering how screwed he really is.

The question is can he still be charged with anything based off of the texts back and forth between him and the person that turned him in to their boss?
