I was in the process of buying a home out of state, but during the final walkthrough the day before closing, I discovered several issues that were not in the inspection report. The carpets were urine-stained, the kids’ room had exposed wires coming out of the walls, and there were significant structural problems upstairs that would require extensive contractor work. These issues made the home unsafe for my kids, so I decided to pull out of the deal. Unfortunately, I didn’t take photos of the issues, which I now realize would have helped. As a first-time homebuyer, I feel like both realtors took advantage of me, pushing me into the deal despite these problems. Now, the realtors are trying to sue me for their commission, even though the contract states commission is only due if I pull out without valid reason, and the home sold to someone else two weeks later. I feel my reasons for canceling were justified, but I’m unsure of how to handle this situation legally or protect myself. What steps can I take to address this? Would I have a strong case if they proceed with legal action?
