Rear Ended Without Collision Coverage

Located in Wisconsin. Car has over $10k in damages and bought at $3.5k with a KBB value of $2.5k-$4.5k.
Two weeks ago I was read ended on the high way. I have insurance through Geico, but I don't have collision coverage and didn't realize until I got into the crash.
So what happened was my boyfriend was driving and we were merging on the highway in heavy traffic. After he was fully merged onto the highway for just a couple seconds, traffic was coming to a stop. He braked hard and came close to the car in front of us, then we were rear ended. The sheriff showed up but stated he didn't have time to deal with this and gave us all slips with directions to report the crash online then left. We exchanged information. The other party is telling his insurance that we rear ended the car in front of us first then he rear ended us. Geico called me and did an interview where they decided we are not at fault.
My situation right now is it's been two weeks since the crash. I'm waiting to hear back from his insurance who is waiting on a statement from the driver in front of me, but we've been waiting for about a week now. I'm wondering if and when I should get a lawyer and how I should be handling this. I have no idea how to deal with this ):
