Retailer Trying To Backout Of Sale - What Do I Do?
We received a sales flyer in the mail from a local appliance retailer advertising a Black Friday sale. The mailer featured 2 items, a fridge and a GE all-in-one washer dryer. My wife and I have been planning to purchase 2 of the GE units and the advertised price was excellent. We went to the store with the ad, purchased 2 of the units and told the store we would come back later to schedule delivery. The store finalized the purchase, setup the financing, we signed the receipt and went home. 4 hours later, the store called back and said there was a misprint in the ad and can't honor that price. They want to charge us $800 more. My position is, they already sold them and can't undo that mistake now and should have never sold them to us if they knew the price was wrong. Do we have any recourse? They won't schedule delivery of the units unless we pay the higher price. Should I file a complaint with State Attorney General consumer protection? File a small claims suit? The company won't budget on their position.
