Retaliatory Dismissal? (or)

Card image cap

I was a bar manager, working for a crooked cheapskate. I was very up front about my dissatisfaction with how things ran. We were negotiating a new salary. I'd been there 1.5 years. One night (my night off) one of my bartenders (male) came to work intoxicated, and groped five other male employees by their butts. I had to cover his shift the following day, as the general manager (my boss, and part owner) assessed the situation.

The victims were all in their early 20s, and several of them were very distraught. The GM went around, and coerced them into accepting an apology from the offending bartender. He was given a warning for the offense.

Two days after the incident the GM, and I were discussing the course of action. I was mentally preparing myself to work seven days per week, imagining there's no way we're not gonna fire this guy. My workplace had a rampant history of sexual harassment at every level. When told there would only be a warning, I asked the GM if that was a prudent decision given the history of this place. GM says to my face "it wasn't sexual harassment". I rebut, that it is absolutely sexual harassment. He persists that it is not. I ask him how does he expect me to manage in a place that doesn't enforce safety against such things (on top of all my prior gripes).

Later that night I get a call that I'm no longer manager, but just a bartender. I was fine with that. My conscience couldn't handle being in charge in a place with no discipline/ethics. Two weeks after I'm busted down to bartender I'm fired. Cause for termination is "not a good fit, and going in a different direction". Fine. I qualify for unemployment. I had accrued three weeks vacation, and when I asked if those were paid out I got a "nope" via text message.

Is this something I can/should pursue. They could have fired me for any number of reasons, but it does feel like retaliation. More than anything I want compensation for my vacation time. GM begged me to hang in there until March, and he would allow me some time off. This company has a history of sweeping things under the rug, and I would like to make them accountable for their misdeeds.

Thank you for any advice.
