Roommate Left On A Separate Leasing Agreement

Card image cap

Just as the title says, me and my roommate have separate leasing agreements and both pay our own individual rent. Our separate leasing agreements have a clause that basically says that if we want to get out of our lease early, we would have to pay a reletting charge and every months rent that it takes for the apartment to fill the residence.

This is where the story starts.

Without any notice at all, my roommate randomly on Christmas Eve warned me that he was moving back to India the next day. I told him about the clause and he said that he had already paid the reletting fee. When i said to him that he would have to pay each months rent until they find someone to replace him, he said “I’m just not going to pay it, I already paid them”.

And that he did.

I turned in his keys when I got back a few days after and told the apartment office the situation. They reassured me that since I was on a separate leasing contract that I would have nothing to worry about since I’ve been, and only have to pay my rent.

Over the months the apartment has left messages on the apartment door for him but since he has been in India, there was no way for him to see them.

This morning there was two court summons folders titled “To roommates name (and all other occupants).

With him out of the country and it being just me in the apartment, would I have to worry about anything and what would happen to him? I’ve lost contact with him due to him getting a new phone number as well.
