School Coach Pending Arraignment

Card image cap

A sports coach at our local public high school has an upcoming arraignment for possession of drug paraphernalia and unlawful transaction with a minor 2nd degree. They are a new coach this year and I assume would have likely had a background check. The school does require volunteers to have a background check and excludes volunteers with pending criminal charges. I have two questions: is a public school able to employee the coach with this upcoming arraignment? 2. If so, how can a volunteer legally be held to a higher standard than a school employee with direct student contact? I’m trying to see if I should approach the school administrator about the concern with having high school students alone with this individual or if they are legally (even if not morally) in the right to allow this. The coach is not a teacher but employed only to coach the specific sport. Anyone know what the law is?
