Second Time Car Got Towed Out Of Hoa With No Heads Up On Change Of Rules Either Time
So I'm located in Hampton Roads in Virginia. My boyfriend lives in a development that is an HOA and has lived there for about 5 years now. Apparently the HOA changed, but as far as I am aware, he never received any notice of rule changes. The parking situation is that there are marked spots and unmarked spots, before marked spots were designated to certain residents of the neighborhood, and it seemed that if someone was parked in your spot, you could get them towed. Unmarked spots were for visitors. No parking passes or anything were needed. We never had an issue. Now, the towing company has been coming in overnight and towing cars. My boyfriend's car got towed from his own spot and the reasoning was because he didn't have a pass in his vehicle and he was supposed to read the bulletin in the neighborhood to know about this information. (It's 2024, I feel like most people nowadays only check these things electronically or expect to receive emails or at least physical notifications sent to their house). I want to emphasize that he has lived in this development for 5 years, never had an issue like this or any cars towed, and has never had a parking pass until his car got towed. After his car got towed, we accepted the HOA wasn't going to pay him back for the towing fees, got the correct parking pass for him, and moved on. Now, this morning my car got towed. My car was in an unmarked spot, as I have known to park in for the past 3 years we've been together. The towing company even showed me photos of my car and it was in fact in an unmarked spot. The towing company informed us that we are supposed to have visitor passes as well, but the HOA never told us? We are already upset that we didn't know any of this in general, but I would think that even with my boyfriend going through and finally getting his parking pass that they would also equip him with visitor passes or at least inform him of needing them.
I've looked online and seen some people in similar situations taking this to small claims court. I am not into the fact that I had to drop $200+ to get my car back when I did what I thought I was supposed to do, I just want to get my money back. Obviously it's not the towing company's fault, they're just doing their job.
I'm just looking for recommendations on what I could possibly do about this moving forward, since this is the second time we have gone through this, I do not want to let it slide. Something is really weird about this whole thing. Any receipts I should keep, documents to report/have on record, who I should contact, if this is even something that I could legally do something about. Thanks in advanced!
