Seeking Legal Advice After Losing Kitten To Panleukopenia And Incurring $10k+ In Vet Bills

Hi everyone,

I’m seeking legal advice regarding a devastating situation with a kitten I purchased from a reputable broker in NYC. This has been emotionally and financially overwhelming, and I’d appreciate any guidance.

Key Facts:

  • Delivery Date: December 15th, 2024.
  • Source: A broker with 5-star Google reviews and a solid Instagram following. They import cats from Ukraine and have a strong customer base in NYC. They import kittens internationally from Ukraine.
  • Kitten’s Health: Diagnosed with feline panleukopenia, a preventable and life-threatening disease, on December 25th.
  • Medical History: Vet confirmed the kitten was under-vaccinated (only two vaccines before 16 weeks) and likely contracted the disease before purchase. But broker said 2 vaccines are complying Ukraine vet rules.

Timeline:

  1. December 15th: Kitten delivered to me.
  2. December 19th: Took the kitten to the vet, who noted it appeared healthy but needed additional vaccines, which I administered.
  3. December 22nd–24th: Kitten showed symptoms of lethargy and loss of appetite.
  4. December 25th: Emergency visit to BluePearl Hospital. Diagnosed with panleukopenia. Vet explained the disease’s incubation period aligned with the purchase date, but not sure. The crux is proper vaccinations could have prevented it.
  5. December 26th: To manage costs (over $10,000 between the kitten and my existing cat’s treatment), I allowed the broker to take the kitten back against medical advice.
  6. December 27th: The kitten passed away - I was informed by broker by email.

Financial Impact:

  • Kitten Purchase Price: $2,400.
  • Vet Bills: Over $10,000 (emergency care for the kitten and treatment for my existing cat, who was exposed).

Legal Questions:

  1. Can I pursue reimbursement for vet bills that exceed the kitten’s purchase price in small claims court?
  2. Does the broker’s failure to ensure proper vaccination strengthen my case?
  3. Are there additional legal avenues to hold the broker accountable for selling an under-vaccinated and sick kitten?

I have:

  • Detailed medical records from the vet and emergency hospital.
  • Communication with the broker, including their acknowledgment of the kitten’s condition.
  • Proof of expenses.

Thank you for your time and any advice you can offer.
