Termination - Undue Hardship
Unionized employee- trade
I was injured over a year ago at work I cannot perform my physical job as I can hardly walk. Wsib is working with me, and is trying to encourage my employer to find alternative “desk job”
I’m not sure if relevant but since my injury external hires have been made to jobs I can do “desk” the exact position externally hired for , company previous moved injured workers into.
This has not been done for me, until final assessment work had me just sitting looking at a wall. They have said sly comments in official meetings like “just put a chair outside and have him sit”
10 years at company - foreman and it was been said I was the best at what I did but basically not use now.
Sooo they are terminating me for undue hardship , I want to fight this as I don’t think it’s undue hardship as they had position I could have done, I asked repeatedly for those roles.
Wsib will be retaining me but work has said they don’t want me basically
I want to file a grievance with union as they didn’t even try, 5 months after my injury owners made it clear they were just waiting to “get rid” of me.
Do I have anything?
I’m more mad that for over a year because they wouldn’t “desk” me and didn’t want lost time they “pushed” my restrictions as much as they could, and worked in grey area liek faf said 2 hours driving but they made me drive all day but said take break every 2 hours. Or no repetitive bending so I was given inventory and told to take breaks so it’s not repetitive… this all made me worse
So will I get severance or just kicked to the curb
