Unpaid Child Support
This is a lot so bear with me…
Non-custodial parent owes over $9000 in unpaid child support. (I have a lawyer and the state is involved. )As a result of non payments , Child support services enforced, a federal and state offset to collect unpaid support from tax return. However, the non-custodial parent owes over $100,000 in back taxes and hasn’t filed a return in three years.
Question 1:How and where would the state withdraw past due support? Also, How can I get a wedge offset enforced instead?
I have a lawyer who’s supposed to be “the best” but after paying him 20k over 2 years - his discovery findings of $300,000 income still hasn’t been heard by a judge.
Meanwhile the unpaid $87 weekly support is based off an “estimated” income because there are no current tax returns.
Question 2: What can I do about my lawyer? Can I request lawyer fees be paid by noncustodial parent as well? It’s unlikely but I’m already buried in debt trying to collect child support that wouldn’t even cover my groceries.
I would ask my Lawyer but after promising me the moon and the stars 2 years ago quickly became uninvested and either does not return my calls or (if and when) he responds to my emails with short snide comments like, “not good” or “contact paralegal”
Additionally, he was not present for the last 3 hearings due to either a family emergency or having to appear in court for other cases. ‼️‼️Please advise ‼️‼️
Update based on messages and comments : we were never married. 2 kids. Only retained a lawyer after waiting 3 years for the state to assist in collecting support (from a W2 That showed 67k income and was 5 years old) he makes triple than what is documented. So the lawyer I hired did discovery and found 300k in income. 2 years later… no support and I lost my job making 70k because I couldn’t afford childcare anymore and didn’t qualify for assistance. All this time and money and still nothing to show for it
