Was It Constitutional For Them To Extend My 72 Hour Hold To A 14 Day Hold?
Hi guys.
I'm just going to get straight to the point and with honesty. I am diagnosed borderline personality disorder and bipolar disorder. On November 13th I attempted suicide and was almost successful (they had to give me 3 doses of narcan). I do have prior hospitalizations. One hospitalization was in April.
Fast forward,
I was placed on a 72 hour hold and I was compliant with taking my medicine, going to groups, I'd be out in the day room. They then decided to extend me to a 14 day hold. I had a hearing with the hospital representative and a hearing officer. The representative read a paper that the nurse practitioners and doctors wrote and they lied saying I was not attending groups and that I would isolate myself.
After the hearing, the officer said I am to stay there until doctors say it's okay. I feel like it was unconstitutional because they lied about me not participating.
When I would ask why they are keeping me so long they said it's because I am a liability to the hospital. I get they're trying to cover their ass but if I'm no longer a threat to myself, why keep me? They also told me everything I needed to do and I did as told. This includes going to groups, taking my medicines, being out in the day room, being compliant with the doctors, eating all my meals.
They kept me there for a total of 8 days. I'm also in the state of California.
