We Don't Know What To Do From Here
My fiance worked as a store manager at a cookie shop for over a year. He has a signed contract with his boss stating that he would receive 10% of the annual net sales. The store made at least $240,000+ in net sales during that year, but when the year ended, they didn’t mention or pay the 10% they owed him.
In the 13th month (mid-December), when he brought up the unpaid amount, they told him they had filed for bankruptcy and would be closing the store in two weeks. They claimed they didn’t owe him anything because they were broke and in debt.
We’re not sure what to do. My fiance might not even be listed as a creditor in their bankruptcy filing. I’m a stay-at-home mom, and we have a 17-month-old, so we’re worried about how to proceed. Should we hire a lawyer? How can we find out where they filed for bankruptcy? They’re based in Utah, but my husband managed their store here in Austin,Texas.
Also yes, We have proof documentation of the net sales the store made which is 240k+ annually and the month of December they made 13k+ total as well as his contract/offer letter of the 10%.
