Wife Trapped In A Car Wash, What Kind Of Lawyer, If Any?
In NY. Going to try to be as descriptive as possible.
On the 21st of December at 10PM my wife was dropping off a friend and decided to stop by the 24 hour automatic car wash since there was a lot of salt on the road and we had a trip soon. We've used this car wash a lot at all hours of the day and night. She went in, parked the car, and it turned on, however she heard a loud thump and something seemed off.
After the wash was done, the doors didn't open. The machines turned off, and after some time she exited the car to find her bumper had been cracked and nearly pulled off by the machines (she described it as the part you park on), and her side mirror backing was cracked. She tried the doors, none opened, even the emergency door did not open. She called the carwash, no one picked up. She called both the google number and the number on the website, nothing. The lights were on, but no one picked up, she called four separate times and left messages each time.
Eventually she called the police to come get her out, this was about 30 minutes after entering the car wash. They couldn't reach anyone, no one was manning the desk (there's usually at least one person there), and the doors did not open from their side. They stated the emergency mechanism for the doors had failed, and they had to pry the doors open.
She was able to get her car home with her bumper hanging on by a thread, after over two hours of being stuck. We triple checked, the car wash was listed as open 24 hours that night, all the lights where on when she went in, and everything was open, there was no reason to believe it was closed.
We have pictures of the damages, a police report, and videos/pictures of her calling/trying all the doors. What can we expect when/if we go ahead with this? We'd at least like the damages to the car to be paid off.
