Wife Won A Judgment..now What??
This morning my wife was awarded a six figure judgment in a civil case against the first of two individuals. This person has recently become incarcerated long term.
Clearly there is no income to garnish unless they receive social security. I’m not sure about that. They do own a (mortgaged) home that likely would be in the $300k area current market value. I’m assuming the first step is to file a lien, which we’ve asked our attorney to do, but I’m not sure our attorney would know how best to proceed in actually collecting. She’s a great attorney, and is with a firm I’ve used multiple times for various reasons, but I do know this was her first time in this particular type of suit.
What can we do? Should we hire a PI to ensure we can discover all of the defendant’s assets? Can we petition to force the sale of the assets to collect the judgment? We believe they have been secretly liquidating assets in preparation for their inevitable loss. Can we petition to assume ownership of their assets and have them removed? All advice is appreciated!
Relevant information: Judgment awarded in Arkansas Respondent incarcerated in Texas with pending charges in Arkansas. Current sentence is ten years with approximate one year time served. Properties include one residence in Arkansas, potentially one vacant lot in Arkansas and another in Missouri. Other respondent is the spouse of the incarcerated party but has no criminal charges.
